Wait I'm Confused

So apparently Tim Horton's (a coffee shop) is running a promotion called "Roll Up The Rim", sounds like a great idea if you ask me. But a 10 year old girl found an abandoned cup in the trash, couldn't roll up the rim (huh, does she have no upper body strength that she couldn't unroll a lip on a coffee cup) so she asked a 12 year old friend to help her. The cup turned out to be a winner of a RAV-4.

So now the original owner is claiming it was his and that he should get the prize, but apparently the 12 year old is expecting some kind of payout as well because she/he helped "unroll the rim"?!?

Someone tosses it, someone else finds it, and someone else unrolls the rim and they all want their share? I think the only one that should win is the one who has posession of the cup, which would be the girl that found it.

Does that make any sense at all to you? What do you think?

I say finder's keeper's. The original owner of the cup could have unrolled the rim himself. It's his tough luck.

in the U.S., you lose your property interest in abandoned property. Although it is a question of law, almost every single court has held that when you throw something away, it's abandoned, therefore, the 10 year old wins. i'm not so sure what to do with the 12 year old helper though.

The first finder wins. The original coffee-drinker and the rim-rolling helper are outta luck. Too bad, so sad!

I think the girl that found it should get it. I also think that most Americans are too greedy. But, hey, that's why everyone loves us, right???

well, let me start off by saying THANK THE GODS I no loger work for Timmy's! I HATE roll up the rim, it turns ordinary asses into extravegant assholes. *Ahem*

Now, the 10yr old girl will most likely get the prize (well, her parents), but the 12 year olds parents were smart and filed suit. She helped with the process of 'winning' which makes her intitled to half. Especially since the ownership was found and not bought.

I am not saying it's right, but these are all parents fighting here. Not kids. ANd th eguy who 'bought' the coffee? I am sure there were a thousand people that day buying coffee, and you can't just claim ownership of garbage that you can't prove. However, he is the only one 'of age; to qualify for the winnings anyways.

Technically you have to answer a skill testing question (which I am sure the kids would get, and you have to be 'of age' to win, which is 18 in canada. other then that, it's fair game. No purchase nessesary.

Xmichra - So what kind of "skills test" do they make you complete? I'm intrigued now.

I know there's a Tim Horton's in Port Huron, MI (been there!), but has it actually expanded much beyond that into the U.S.? For those of you who don't know, Tim Horton's is basically the Canadian version of Dunkin' Donuts.
Also, isn't the old saying: "Possession is nine-tenths of the law."? I guess it's the other tenth that always causes the problems!

Exactly, I agree w/the big finn. I don't care who said they "owned" it, past tense. Who actually has the cup on their hand! That's who gets the prize.

For her help, the "rimmer" if you will =) should be compensated, for without her help, the prize may never have been discovered, the owner would probably have thrown it away as well.

So, if I was the judge, the purchaser gets ZERO! The girl who claimed the garbage gets 100% but she should not be greedy, and recognize the help her friend gave by doing the "rim-job" if you will =).

If she doesn't, then that little thing called Karma will bite her in the ass.

CHGirl - So do they think Canadian's can't do math, but if they can then they win a prize?

it is indeed a math question, but you only have to do that for prizes over a thousand dollars. this makes it a lottery rather than gambling (captain howdy nailed that one), but the question is the same for one person as it is for all. It is a sheet you have to fill out upon winning on a tab. You bring in the tab, we give you a sheet of paper that is a fullscap size with itty bitty writting, and you fill in the blanks. It's all rather simple, but I have seen a few wrong answers on the pages... silly people.

I don't think Tim's should get involved at all. they are already giving away frickin cars for coffee. Not like the sales don't sky rocket for roll up time.. but still. Not thier problem at all.
Unfortunatly if the greedy bastards who are fighting over all of this ruin roll up the rim next year (which is being talked about now as another subsection of laws) then no one will have to worry abou tit at all. Youwill have to enter a ballot in a draw after purchase... nice going huh?

Thank you Canadian Friends for explaining that. I've seen that "rule" before on contests that are run in the US but open to Canada and could never figure out why there was a "skills" test involved.
